The Texas addendum for an offer tied to your sale

Buying in The Woodlands Before Your Current Home Sells: The Texas Sale Contingency Addendum

Updated November 2026

Can I make an offer on a home in The Woodlands that depends on selling the home I own now?

Yes: in October 2026, TREC's sale-of-other-property addendum lets a Woodlands offer depend on your current home selling and closing, though the seller may keep weighing other offers.

When does a Texas offer use the sale-of-other-property addendum?

Texas has a state form for this: the Addendum for Sale of Other Property by Buyer, promulgated by the Texas Real Estate Commission. TREC says the addendum is for a buyer who cannot buy the new home unless the current one is sold and closed.

Attached to a contract on a Woodlands house, it ties the purchase to the sale and closing of the home you own now.

Use the form itself rather than a homemade clause. TREC's notice on its list of contracts and addenda says license holders must use the commission's forms. It warns that errors in using one can cost money or leave a contract that cannot be enforced.

This Addendum is used if the Buyers will be unable to buy the new property unless their existing property is sold and closed.

What should your own Woodlands house have settled before the contingent offer goes in?

Start with a home valuation of the house you are selling, built from recent sales in its own section and utility district. That figure shows what the purchase can rest on and whether your sale date holds up. Request one before the offer goes in.

Then search your house's Township permit record. Most exterior work in The Woodlands needs the Township's written approval, every roof replacement and repainting included, and the current owner answers for any existing violation.

A complete application is acted on within 45 days or automatically disapproved. Finding a gap before your buyer's option period keeps one missing approval from unsettling two contracts at once.

How does the Woodlands calendar bear on the date in the addendum?

As of November 2026, the median Woodlands home sold after 58 days on the market. The pace moves with the season, and that shapes the date you write into the addendum.

Redfin's community median was 51 days in the three months to February 2026 and 22 in the three months to June. Compare your listing month with the same months a year earlier before you settle on a date.

The village counts too. Redfin's village medians for June through August 2026 ran from 22 days in Indian Springs to 54 in College Park. In the same months, 39.3% of Woodlands homes had a price cut before selling.

How can the next Woodlands address change what your sale needs to bring?

Village prices spread widely. Redfin's village medians for June through August 2026 ran from $363,575 in College Park to $818,605 in Creekside Park.

The tax bill moves as well. For tax year 2025, homes in the Montgomery County villages paid about $1.69 to $1.89 per $100 of value in all, depending on the utility district.

Creekside Park, the one village in Harris County, paid about $2.44 per $100 under Harris County's units, Tomball ISD and MUD 386. The parcel's appraisal district account lists every unit that taxes the next house.

Questions & answers

The Woodlands questions, answered

If a Woodlands seller accepts my contingent offer, can they still look at other offers?

Yes. The Texas Real Estate Commission says nothing prohibits a license holder from presenting more than one offer at a time to a seller. TREC adds that a seller may receive, review and negotiate several offers simultaneously. A purchase that depends on your own sale leaves that door open while your listing runs, so expect the seller's agent to keep presenting offers.

Keep your own listing moving, since the pace of your sale is the part of the arrangement you control. Ask the seller's agent early how they handle more than one offer on the house.

Do I need a sale contingency if I can buy the Woodlands house without selling mine first?

Talk to your lender first. TREC says the addendum is used if buyers will be unable to buy the new property unless their existing property is sold and closed. If your financing lets you close on the next Woodlands house without that sale, the addendum's stated purpose does not describe your purchase, and you and your agent can weigh an offer without it.

Ask the lender in writing how carrying both houses would work. Set that answer beside your listing plan before you decide how to write the offer.

How do I check flooding on the Woodlands house I am buying while my own house is still listed?

Run the checks inside the option period on the purchase. Read the current FEMA flood map for the parcel, ask the seller whether the house has flooded or had a flood claim, and ask the utility district about drainage in the section. The Texas Department of Insurance says most flood policies have a 30-day waiting period, so price one early.

In Creekside Park, compare FEMA's draft Harris County maps released February 12, 2026, which are not final and do not change insurance requirements. Spring Creek flooded homes in Timarron and Timarron Lakes in 2016 and again in Hurricane Harvey in 2017.

Will moving to another part of The Woodlands change my school district?

It can. Conroe ISD serves every part of The Woodlands except Creekside Park, which is in Tomball ISD, and May Valley, which is in Magnolia ISD, according to the footnotes on the developer's 2025 tax sheet. A mailing address or ZIP code does not settle the district; the parcel's appraisal district account lists the district that taxes it.

Campus attendance zones are set by each district, so confirm the campuses for the next address with the district itself before you write the offer.

Who should help me fill in a sale contingency addendum for a Woodlands offer?

A real estate license holder or an attorney. TREC's notice on its promulgated contracts and addenda says anyone obtaining the forms for possible use in a real estate transaction should contact one of them for assistance. The dates and terms you write into the addendum bind you once it is signed, so have each blank explained before you sign.

Ask the agent to walk you through each blank before you sign. Have them show how the dates line up with your own listing and with the closing on the next house.
